
Preface: The Constitution of the People’s Republic of China (China’s Constitution of 1982) was adopted by the Fifth Session of the Fifth National People’s Congress, Beijing, China, 4 Dec., 1982.
The Constitution has five sections which are the preamble, general principles, fundamental rights and duties of citizens, structure of the state (which includes such state organs as the National People’s Congress, the State Council, the Local People’s Congress and Local People’s Governments and the People’s Courts and the People’s Procuratorates), the national flag and the emblems of the state.
It highlights in the preamble: “China is one of the countries with the longest histories in the world. The people of all nationalities in China have jointly created a splendid culture and have a glorious revolutionary tradition.”
“The state promotes the development of literature and art, the press, broadcasting and television undertakings, publishing and distribution services, libraries, museums, cultural centres and other cultural undertakings, that serve the people and socialism, and sponsors mass cultural activities. The state protects places of scenic and historical interest, valuable cultural monuments and relics and other important items of China’s historical and cultural heritage.” (Article 22)

Descriptions
- The first Constitution of the PRC was declared in 1954. After two intervening versions enacted in 1975 and 1978, the current Constitution was promulgated by National People’s Congress (NPC) for implementation in on December 4, 1982.
- Subsequently, the China’s Constitution of 1982 has been amended and adopted respectively at the First Session of the Seventh NPC on April 12, 1988, the First Session of the Eighth NPC on March 29, 1993, the Second Session of the Ninth NPC on March 15, 1999 and the Second Session of the Tenth NPC on March 14, 2004.
